ON MAY 12, 2003 AND ORDER OF THE BOARD
This prehearing was established to begin the process of hearing preparation for two matters appealed by York Rowe Ltd. in the Yorkville area of Toronto.The Board heard that the parties have not yet established what issues will need to be canvassed in the hearing and thus another prehearing conference is necessary.
The Board sets:
Thursday, July 17, 2003 at 10:00 a.m. at the Ontario Municipal Board offices, 655 Bay Street for one (1) day for the next prehearing. At that time, a pre-circulated issues list will be considered. In anticipation of that event, the Board directs York Rowe Ltd. to circulate its most recent version of the site plan to all parties no later than Friday, May 23, 2003. If issues arise from this circulation, the Board can be spoken to.
The hearing itself will commence:
Monday, August 25, 2003 at 10:00 am at the Ontario Municipal Board offices, 655 Bay Street for fourteen (14) hearing days.
ABC Ratepayers do not as yet know what position the City will be taking in this hearing. In order to assist, the Board has set almost three weeks aside. If it becomes apparent that less time is necessary this can be addressed at the next prehearing. The Board will also make every effort to accommodate personal restrictions of counsel for ABC on August 27 and 28 th .
Two participants have been added to the proceedings:
B. deLange on behalf of the Bloor-Yorkville BIA, and J. Coltman on behalf of Allied Properties.
Any additional participants will need to be identified at the next prehearing on July 17. All participants will be required to exchange a brief written summary of their intended evidence, similar to witnesses called by the parties, in accordance with the directions of the Boards procedural order to be finalized at the next prehearing. A specific time for participants to present their opinions will be established at the next prehearing conference, or on the first day of the hearing.
No further notice of these proceedings is required. This member is seized of this matter.
